Terms & Conditions

General

It is forbidden to bring/to consume drugs and doing any sexual activity onboard Aneecha Sailing Catamaran and/or during charter time.
Aneecha Sailing Catamaran will not tolerate for any drugs onboards, and will report it to authorities.

 

Rates and Reservation

Bookings are made in accordance with this valid agreement.

All prices and rates, unless specified otherwise, are included tax and service charge.

Billing and Payment

The payment must be made according to the following calculation after the yacht charter reservation is confirmed:

50% advance payment at the time of yacht reservation.

50% of the balance must be paid seven days prior to the yacht charter date.

Aneecha Sailing Catamaran is not responsible for any released charter date caused by no down payment confirmation from the client.

All payments have to be done according to payment instructions listed in the Pro-forma Invoice which the Company has sent either to Client or to Agency.

Unless otherwise specified, all payments must be made under the instructions on the forma invoice that the Company has either sent to the Client or the Agency. Yacht charter shall only be approved once the full amount for yacht charter and all extra services has been paid in full.

If either advance payment or balance payment has not been fully settled until above stated deadlines, the Company shall be entitled to cancel the yacht’s booking without any refunds to the Client.

 

Extended Charter Time

Extended charter time is available based on agreement among both parties.

 

Cancellation:

Regardless of the reason for the cancellation, the Client must notify the Company immediately about the cancellation by email if the charter of the booked vessel is cancelled by the Client.

In the event of cancellation, the client will be charged the following amount:

up to 50% of the full charter rate if the cancellation has been done up to 30 calendar days prior to the starting date of charter.

up to 100% of the full charter rate if the cancellation has been done less than 7 calendar days prior to the starting date of charter.

 

Rescheduling Policy:

Charter rescheduling date is allowed under these specified conditions:

A charter reschedule is permitted when proposed at least 7 days prior to the original charter date, but there may be a rescheduling fee or it may not be accepted, depending on the specific terms of the charter agreement.

Rescheduling requests made between 6 – 0 day of the charter date will not be accepted, and it will be treated as a no-show, and no refunds will be issued. Cancellation of a rescheduled booking will be subject to our standard cancellation policy.

During adverse weather conditions, Aneecha Sailing Catamaran will adhere to the instructions or briefings published by the Harbour Master and Port Authorities. It must be noted that Aneecha will remain on schedule if there are no cruise/sail restrictions issued by the Harbour Master/Port Authorities due to the current weather conditions.

 

 

Damage Regulation/Unpredictable Human Actions:

The client is responsible for any damage because of improper handling the vessel and its equipment:

Repair of the damage and/or loss of equipment, damage to engine or sails caused by the fault of the unpredictable human actions shall be paid to the Aneecha Sailing Catamaran.

Aneecha Sailing Catamaran will take the estimated damage amount, of which the precise calculation should be given within a reasonable period of time.

 

Force Majeure:

Aneecha Sailing Catamaran shall not be liable for any loss, damages or delay or failure in performance hereunder resulting from any force majeure event, including but not limited to acts of God, fire, action of the elements, epidemics, war (declared or undeclared), warlike actions, insurrection, revolution or civil strife, piracy, civil war or hostile action, strikes or differences with workmen, acts of the public enemy,  federal  or state laws, rules and regulations of any governmental authorities having or asserting jurisdiction in the premises or of any other group, organization or informal association (whether or not formally recognized as a government), and any other cause beyond the reasonable control of Aneecha Sailing Catamaran which makes continuance of operations impossible.

 

In the event of a delay or failure of performance based upon an event described above:

All payments made towards the charter shall be used as a credit for a future charter. No refunds will be provided.

Aneecha Sailing Catamaran will not be responsible for additional costs incurred by Charterer as a result of changes to their charter due to a force majeure event.
